How do I make a Will?
The first step is to contact a lawyer or Will-writing service. You can discuss your wishes with them and they will make sure your Will is properly drafted. Here are some useful links for finding a professional to write your Will:
I already have a Will. Can I make changes to it?
You can make small changes to your Will by writing a Codicil, which is a document written to explain or modify parts of your Will without replacing it entirely. More significant changes may require you to write a new Will. A professional will be able to advise you on which way is best for the changes you wish to make.
Is now the right time to make a Will?
A lot of people choose to prepare theirs after a big milestone (like buying a house) but you can choose to make your Will whenever it feels right for you.
Who should I name as the executors in my Will?
It is typical for an executor to be a trusted family member or friend. Make sure to ask them if they are willing to be your executor before naming them in your Will.
You also have the option to appoint a professional executor, such as a solicitor or a bank. This brings the benefit of additional expertise, but does come also with professional fees.
How do I leave a gift to Bendrigg or another charity in my Will?
Your lawyer will prepare the appropriate wording for you to give a gift to charity in your Will in line with your intentions. How do I make sure I am both looking after my loved ones and helping charities?
Taking care of loved ones is the top priority when making a Will. We would prefer that you look after friends and family first — then we would love for you to consider a gift from anything that is left over.
What type of legacy gift is best to leave to charity?
With advice from your lawyer, you should choose the types of gift that prioritise your wishes for your loved ones and your legacy. From our perspective, a percentage gift (also called a residuary legacy) can be the best choice for retaining value long-term because it is the most resistant to inflation and can grow alongside your estate.
Is it worth leaving a gift even if I don’t have much to give?
Absolutely! At Bendrigg, we are grateful for each and every legacy. All gifts, no matter how big or small, will change lives.
Can I choose how my gift is spent?
Yes, you can specify what you would like your money to be used for; this is called a restricted gift. However, there is a risk of us legally having to forfeit the gift if we cannot spend it accordingly. If you are considering leaving us a restricted gift, please get in touch.
I’ve included a gift to Bendrigg in my Will. What happens next?
Thank you for your generosity! You don’t have to tell us if you have chosen to leave a legacy to Bendrigg, but if you are happy to let us know we would love the opportunity to thank you properly and keep you updated about our work.
What effect does leaving a gift to charity have on Inheritance Tax?
The value of any gift you leave to charity in your Will is taken off of the total value of your estate before Inheritance Tax is calculated, so it is possible that a gift to charity can reduce how much tax is payable. If more than 10% of the total value of your estate is left to charity, you may also qualify to pay Inheritance Tax at a reduced rate.
What happens with my estate if I don’t make a Will?
If you pass away without a valid Will, your estate goes to intestacy. This means that it will be managed and distributed according to the standard legal rules instead of your personal wishes. Typically, your estate will be inherited by your closest relative, identified by following a particular order (referred to as the ‘order of priority on intestacy’).
Where should I store my Will?
It is important that your original Will is stored somewhere safe. This could be with the HM Courts and Tribunals Service, with the professional who wrote your Will, or somewhere secure at home. Some banks also offer the option to store your Will for you. It is useful to keep a photocopy of your Will for reference, and to let your executors know where the original is stored.
